1. Acceptance of Terms
By registering for or using QYUBIC X ("Platform", "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.
2. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into contracts under applicable law. Brands must be duly registered entities. By using the Platform, you represent that you meet these requirements.
3. Platform Services
QYUBIC X provides a managed affiliate and influencer marketing platform that facilitates:
- Campaign creation and management for brands
- Influencer discovery, invitation, and assignment
- Campaign performance review (reported clicks, orders, commissions)
- Content submission and review workflows
- Payout management in AED and other MENA currencies
4. Brand Obligations
- Provide accurate campaign briefs, budgets, and commission structures
- Approve or reject influencer applications in a timely manner
- Pay commissions and fixed fees as agreed within the platform
- Comply with UAE advertising standards and applicable regulations
5. Influencer / Creator Obligations
- Provide accurate audience and demographic data
- Produce content that meets brand briefs and platform guidelines
- Disclose paid partnerships in compliance with UAE Influencer Marketing Guidelines issued by the National Media Council
- Not engage in click fraud, fake followers, or artificial performance inflation
6. Commissions and Payments
All commissions are based on approved campaign terms and validated outcomes recorded in the Platform. QYUBIC X acts as a facilitator and is not responsible for disputes arising from technical tracking issues outside our control. Payout timelines are subject to brand approval cycles.
7. Intellectual Property
Brands retain ownership of campaign materials. Influencers retain ownership of created content but grant brands a non-exclusive licence to use approved content as specified in the campaign brief. QYUBIC X retains all rights to the Platform software and design.
8. Limitation of Liability
To the maximum extent permitted by UAE law, QYUBIC X shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform. Our total liability shall not exceed the fees paid by you to QYUBIC X in the preceding 3 months.
9. Termination
Either party may terminate their account at any time. QYUBIC X reserves the right to suspend or terminate accounts for breach of these Terms, fraudulent activity, or violations of UAE law without prior notice.
10. Governing Law
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
